I am still confused about subpoenas in the Jones vs Abel lawsuit
I am still confused about all of this. Can someone kindly explain how the subpoena process worked in that lawsuit?
What we do know thus far is...
In Aug, the following happened: Jones confiscated Abel's phone. At some point, still in Aug, Lesley called Nathan and said she saw her texts and she will be sued.
Did Jones get a subpoena afterward to legitimise the texts, for her to add them to her lawsuit in Dec? Can you get subpoenas before a lawsuit has been filed? Or are there other contexts I am missing?
In Towhey's emails to JB team, she says: The complaint includes extensive private text messages and emails she obtained through a subpoena that document the crisis communication operation.
Did BL team mislead the NYT by saying they obtained the texts through a subpoena?
Lastly, a few more follow up questions about subpoenas:
- Can you share information you obtained from a subpoena to a different party? Under which conditions are you allowed to do that?
- What happens if you share manipulated text, which someone then uses in their complaint or news article?
Where is the subpoena? Albertson and Davidson (at around 25:30 they discuss this issue. Mystery not solved).
